Terms of Service

1. Acceptance of Terms

Welcome to BibScore! These Terms of Service ("Terms") govern your access to and use of the BibScore mobile application (the "App"), website at bibscore.com (the "Site"), and all related services (collectively, the "Service") provided by BibScore ("we," "us," or "our").

By creating an account, downloading, installing, or otherwise accessing or using the Service, you affirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.

We reserve the right to update these Terms at any time. We will make reasonable efforts to notify you of material changes via the App, email, or a prominent notice on the Site. Your continued use of the Service after such changes constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

2. Eligibility and Age Requirements

The Service is intended for use by adults. No one under the age of 18 may create an account or use the Service. The Service is not directed to children under the age of 13, and we do not knowingly collect personal information from children under 13.

By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.

Although BibScore helps parents and caregivers evaluate family-friendly restaurants, the Service itself is for use by adults only. Parents and caregivers should not allow children to create accounts or submit content through the Service. If we become aware that we have collected personal information from a child under 13, we will take steps to delete that information promptly. If you believe that a child under 13 has provided us with personal information, please contact us at the address in Section 22.

3. Account Registration

To access certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

4. Description of Service

BibScore is a community-driven platform that helps parents and caregivers find family-friendly restaurants by crowdsourcing data about amenities and experiences, including but not limited to: diaper-changing stations, high chairs, play areas, noise tolerance, staff attitude, pacing, and other family-relevant attributes. The Service aggregates user-submitted reports into a composite family-friendliness score (the "BibScore") for participating restaurants.

BibScore does not independently verify user submissions and does not guarantee that any ratings, reviews, scores, or amenity reports are accurate, complete, reliable, or current. Scores and reports reflect the subjective experiences of contributing users and should be used as a general guide, not as a guarantee of any restaurant's actual conditions. Restaurant amenities, policies, and conditions may change at any time without notice.

BibScore does not endorse any user opinions expressed through the Service.

5. Platform Status

BibScore provides a platform through which users share their experiences. User Content is created and submitted by third-party users, not by BibScore. To the fullest extent permitted by applicable law, including Section 230 of the Communications Decency Act (47 U.S.C. § 230), BibScore is not responsible for User Content submitted by third parties.

BibScore may use automated and manual tools to organize, display, moderate, analyze, and aggregate User Content. Such activities do not make BibScore the author, publisher, or speaker of any individual user's submission.

6. User-Generated Content

6.1 Your Content

The Service allows you to submit reports, ratings, reviews, photographs, and other content ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant BibScore a worldwide, non-exclusive, royalty-free license to host, store, display, reformat, moderate, analyze, aggregate, and otherwise use your User Content in connection with operating and improving the Service.

This license includes the right for BibScore to analyze and aggregate User Content to generate ratings, scores, insights, and other metrics used within the Service, including through automated or algorithmic processes. This license does not include the right to use your photographs, reviews, or other User Content in external marketing or promotional materials without your separate, express consent.

6.2 Public Visibility of User Content

User Content may be publicly displayed within the Service and may be visible to other users, businesses, and the general public. User Content may also be associated with your profile, username, or contribution history. By submitting User Content, you acknowledge and agree that your submissions are not confidential and may be viewed by anyone with access to the Service.

6.3 User Representations and Warranties

By submitting User Content, you represent and warrant that:

  • You own or have obtained all necessary rights, licenses, and permissions to submit the User Content.
  • Your User Content does not infringe, misappropriate, or violate the intellectual property rights, privacy rights, publicity rights, or other rights of any third party.
  • Your User Content is based on your honest personal experience and does not contain knowingly false statements about any person, business, or establishment.
  • You have obtained the consent of any identifiable adults depicted in photographs or other media you submit.

6.4 Photographs and Minors

Because BibScore serves parents and caregivers, users may be inclined to capture or share images from family-friendly settings. To protect the privacy of children and bystanders:

  • You may not upload photographs depicting minors (individuals under 18) unless you are the minor's parent or legal guardian or have obtained consent from the minor's parent or legal guardian.
  • You should avoid uploading photographs that prominently depict the faces of bystanders, other diners, or restaurant staff unless necessary to illustrate your experience and you have obtained their consent.
  • BibScore reserves the right to remove photographs that appear to violate these standards, with or without notice.

These guidelines are not just legal requirements — they reflect BibScore's commitment to maintaining a safe and respectful community.

6.5 Content Standards

You agree that your User Content will not:

  • Contain false, misleading, or intentionally inaccurate information about a restaurant, its staff, or its conditions.
  • Include hateful, threatening, defamatory, obscene, or otherwise objectionable material.
  • Violate any applicable law, regulation, or third-party rights, including intellectual property and privacy rights.
  • Contain spam, advertising, solicitations, or promotional material unrelated to the Service.
  • Include personal information about restaurant employees or other individuals without their consent.
  • Be submitted with the intent to manipulate scores, deceive other users, or harm any restaurant's reputation through knowingly false claims.
  • Constitute personal attacks or character judgments about individuals rather than descriptions of your experience.

6.6 Content Moderation

We reserve the right, but are not obligated, to review, remove, refuse to post, restrict, reclassify, redact, or reformat any User Content at our sole discretion, including content that violates these Terms or that we find objectionable. Any non-substantive formatting, categorization, or technical adjustments made by BibScore to User Content do not alter the meaning or substance of the original submission. We may suspend or terminate accounts that repeatedly violate our content standards.

Good-faith content moderation decisions made by BibScore, including the removal or restriction of User Content, do not create liability under applicable law.

6.7 Content Retention After Account Deletion

If you delete your account, we will make reasonable efforts to remove your personally identifiable information from the Service. However, User Content that has been aggregated into BibScores or other anonymized metrics may be retained in de-identified form. Additionally, copies of your User Content may remain in our backup systems for a reasonable period following deletion. User Content that has already been shared, redistributed, or indexed by third parties may persist outside our control.

7. Incentives and Rewards

BibScore may offer rewards, points, badges, perks, or other incentives for participation in the Service. Such incentives are offered for truthful, good-faith contributions and are never conditioned on positive, negative, or any particular sentiment in your User Content. You must provide honest feedback regardless of any incentive.

Where required by applicable law or Federal Trade Commission guidelines, incentivized contributions may be labeled or disclosed within the Service. Attempting to manipulate incentives through fraudulent, coordinated, or duplicative submissions is a violation of these Terms and may result in account suspension or termination.

8. Content Disputes and Restaurant Claims

8.1 Restaurant and Business Owner Disputes

Restaurants, business owners, or individuals who believe that User Content is inaccurate, defamatory, harassing, or otherwise violates these Terms may submit a dispute through the procedures described on the Site or by contacting us at the address in Section 22. We will review disputes in good faith and may, at our sole discretion, remove, restrict, or add informational context to disputed content.

Where BibScore adds its own informational context to disputed content, such context constitutes BibScore's own statement and is drafted with care to be factual and proportionate.

Submitting a dispute does not guarantee that content will be removed. BibScore reserves the right to determine, in its sole discretion, whether User Content violates these Terms.

8.2 DMCA Copyright Policy

BibScore respects the intellectual property rights of others and complies with the Digital Millennium Copyright Act ("DMCA"). If you believe that content on the Service infringes your copyright, you may submit a DMCA takedown notice to our designated agent with the following information:

  • A physical or electronic signature of the copyright owner or an authorized agent.
  • Identification of the copyrighted work claimed to have been infringed.
  • Identification of the material that is claimed to be infringing, with information sufficient to locate it on the Service.
  • Your contact information, including address, telephone number, and email address.
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner.

Note: To maintain DMCA safe-harbor protections, this designated agent must also be registered with the U.S. Copyright Office's designated agent directory. It is your responsibility to ensure this registration is completed and kept current.

Upon receipt of a valid DMCA notice, we will remove or disable access to the allegedly infringing material and notify the user who posted it. Users may submit a counter-notification if they believe the removal was made in error, in accordance with the procedures set forth in the DMCA.

8.3 Repeat Infringer Policy

BibScore will terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms.
  • Attempt to gain unauthorized access to any portion of the Service, other accounts, or any systems or networks connected to the Service.
  • Use any automated means (bots, scrapers, crawlers, spiders) to access, collect, harvest, or index data from the Service without our prior written consent.
  • Use the Service or its content to build, train, or populate a competing database, dataset, application, or service.
  • Use the Service or any content obtained from the Service for any commercial purpose without our prior written consent, including resale, redistribution, or licensing of BibScores, reviews, or aggregated data.
  • Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure.
  • Impersonate any person or entity, or falsely represent your affiliation with any person or entity.
  • Submit fraudulent reports or attempt to manipulate restaurant scores through fake, coordinated, or incentivized-for-sentiment reviews.
  • Harass, intimidate, or threaten any other user, restaurant employee, or business owner.
  • Reverse-engineer, decompile, disassemble, or attempt to derive the source code of any part of the Service.
  • Systematically download, store, or republish content from the Service.

10. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are and will remain the exclusive property of BibScore and its licensors. The Service is protected by copyright, trademark, trade secret, and other intellectual property laws. Our trademarks, logos, and trade dress may not be used without our prior written consent.

BibScore's nonpublic scoring algorithms, weightings, models, anti-fraud systems, and internal datasets constitute proprietary trade secrets of BibScore. The database of aggregated and compiled restaurant data as displayed through the Service constitutes a copyrighted compilation. Unauthorized reproduction, distribution, or commercial exploitation of these materials is prohibited.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy explains what information we collect (including personal information, location data, device identifiers, and usage data), how we use and share it, how long we retain it, your rights regarding that data (including how to request deletion), and the categories of third-party service providers who may process your data.

By using the Service, you consent to the collection, use, and disclosure of information as described in the Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy regarding the treatment of your personal information, the Privacy Policy shall control.

Because User Content may be publicly visible (see Section 6.2), the Privacy Policy also describes how publicly posted information is treated, including the limitations on deletion of content that has been aggregated, de-identified, or indexed by third parties.

12. Location Data

The Service may request access to your device's location services to provide location-based features, such as identifying nearby restaurants and providing relevant recommendations. With your permission, the Service may collect precise or approximate location data from your device, including GPS coordinates and device identifiers.

Location data is used to enhance your experience with the Service and, as further described in our Privacy Policy, for analytics and Service improvement. We do not sell your location data to third parties. You may disable location services at any time through your device settings, though this may limit certain functionality of the Service.

13. Third-Party Services and Links

The Service may contain links to or integrations with third-party websites, services, or content, including restaurant websites, mapping services, and other resources. We do not control, endorse, or assume responsibility for any third-party content or services. Your interactions with third-party services are governed by their respective terms and policies.

14. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. WE SPECIFICALLY DISCLAIM ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; (B) ANY BIBSCORE, RATING, REVIEW, OR INFORMATION WILL BE ACCURATE, COMPLETE, OR CURRENT; (C) ANY RESTAURANT WILL HAVE THE AMENITIES OR CONDITIONS INDICATED BY USER REPORTS; OR (D) THE SERVICE WILL MEET YOUR REQUIREMENTS.

YOU ACKNOWLEDGE THAT: RESTAURANT CONDITIONS, AMENITIES, STAFF, AND POLICIES MAY CHANGE AT ANY TIME WITHOUT NOTICE; BIBSCORES REFLECT AGGREGATED USER OPINIONS, NOT VERIFIED FACTS; AND BIBSCORE DOES NOT GUARANTEE THE SAFETY, CLEANLINESS, ACCESSIBILITY, OR SUITABILITY OF ANY RESTAURANT OR ESTABLISHMENT LISTED ON THE SERVICE.

YOU USE THE SERVICE AND RELY ON ANY INFORMATION PROVIDED THROUGH THE SERVICE ENTIRELY AT YOUR OWN RISK.

15. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIBSCORE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, ANY USER CONTENT, OR ANY RESTAURANT CONDITIONS OR AMENITIES REPORTED THROUGH THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE EXCEED THE GREATER OF: (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) FIFTY DOLLARS ($50.00).

16. Indemnification

You agree to indemnify, defend, and hold harmless BibScore and its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content, including any claims that your User Content infringes, misappropriates, or violates the rights of any third party, or is defamatory, inaccurate, or otherwise unlawful; (c) your violation of these Terms; or (d) your violation of any applicable law or the rights of any third party.

17. Dispute Resolution and Arbitration

17.1 Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us at the address in Section 22 and attempt to resolve the dispute informally for at least thirty (30) days.

17.2 Binding Arbitration

If we cannot resolve a dispute informally, you and BibScore agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, except as modified by this section. The arbitration shall take place in Harris County, Texas, or at another mutually agreed location, or may be conducted by phone or videoconference at the arbitrator's discretion.

The arbitrator shall have exclusive authority to resolve all disputes, including the scope, enforceability, and arbitrability of this arbitration agreement.

17.3 Class Action Waiver

YOU AND BIBSCORE AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A CLASS OR REPRESENTATIVE PROCEEDING.

17.4 Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of intellectual property rights. Claims eligible for small claims court may also be brought in such court.

17.5 Opt-Out

You may opt out of this arbitration agreement by sending written notice to the address in Section 22 within thirty (30) days of first accepting these Terms. If you opt out, the Governing Law provisions in Section 18 will apply.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. To the extent that litigation is permitted under these Terms (including if you opt out of arbitration), you consent to the exclusive jurisdiction and venue of the state and federal courts located in Harris County, Texas.

19. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us or using the account deletion feature within the App.

Upon termination, your right to use the Service will immediately cease. As described in Section 6.7, certain User Content may be retained in de-identified or aggregated form after account deletion.

Sections that by their nature should survive termination will survive, including Sections 5, 6.1, 6.2, 6.3, 6.7, 7, 8, 10, 14, 15, 16, 17, and 18.

20. Data Deletion and Retention

You may request deletion of your personal information by contacting us at the address in Section 22 or by using the account deletion feature within the App. Upon receiving a verified deletion request, we will delete your personal information within a reasonable period, subject to the following exceptions:

  • We may retain certain information as required by applicable law, regulation, or legal process.
  • We may retain information necessary for legitimate business purposes, such as fraud prevention, enforcement of these Terms, and resolution of disputes.
  • De-identified or aggregated data derived from your User Content may be retained as described in Section 6.7.
  • Backup copies may persist for a reasonable period following deletion.

21. General Provisions

Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and BibScore regarding the Service and supersede all prior agreements and understandings.

Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment. You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign our rights and obligations under these Terms without restriction.

Notices. We may provide notices to you via the App, email, or other reasonable means. You may contact us at the address below for any notices required under these Terms.

Force Majeure. BibScore shall not be liable for any failure or delay in performance due to causes beyond its reasonable control, including natural disasters, war, terrorism, labor disputes, government actions, or internet or infrastructure failures.
